Terms of Service

Effective Date: September 16, 2026

These Terms of Service ("Terms") govern your access to and use of the Marketers Video Player website, dashboard, embeddable video player, and related services (collectively, the "Service"). The Service is operated by Bobby Intelligent Project Solution Inc., operating as Marketers Video Player ("MVP," "we," "us," or "our"), a corporation existing under the laws of the Province of Ontario, Canada. By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

MVP provides tools that let you turn video content into interactive experiences, including embeddable video players, timed calls-to-action, email capture and opt-in forms, in-video popup offers, content revealers, social share/lock features, engagement analytics, and webhook integrations to third-party tools such as Zapier, Make, and various CRMs and autoresponders. Depending on your plan, AI-assisted copywriting features ("AI Pro") may also be included.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@marketersvideoplayer.com if you suspect unauthorized use of your account.

3. Plans, Billing & Payment

The Service is offered under Standard and AI Pro plans, billed monthly, annually, or as a one-time lifetime payment, as described on our pricing page. Payments are processed by Stripe; we do not store your full payment card details. Subscription plans renew automatically at the end of each billing period unless cancelled beforehand. Prices are subject to change with reasonable notice, and changes will not affect a billing period you have already paid for. You are responsible for any applicable taxes.

4. 30-Day Money-Back Guarantee

New purchases of Standard or AI Pro (monthly, annual, or lifetime) are covered by a 30-day money-back guarantee. If the Service isn't working for you, contact support@marketersvideoplayer.com within 30 days of your purchase; if we're unable to resolve the issue, we will refund your payment in full, no questions asked. This guarantee applies to your first purchase of a given plan and is intended to address ordinary use of the Service, not fraudulent or abusive refund requests.

5. Cancellation

You may cancel a monthly or annual subscription at any time through your account dashboard or by contacting support; cancellation takes effect at the end of your current billing period, and we do not provide prorated refunds for partial periods outside of the guarantee in Section 4. Lifetime purchases are one-time payments and are not subject to recurring cancellation.

6. Acceptable Use

You agree not to use the Service to:

  • Upload, distribute, or link to unlawful, infringing, defamatory, or fraudulent content;
  • Collect personal information from viewers through opt-in forms without a lawful basis and appropriate disclosure, or send unsolicited communications in violation of applicable anti-spam laws (including Canada's CASL);
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
  • Resell or white-label the Service without our prior written consent; or
  • Use the Service in a manner that violates the terms of any third-party platform you embed it on or integrate it with (e.g., YouTube, Zapier, Make).

7. Your Content

You retain ownership of the video content, copy, and lead data you upload to or collect through the Service ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you. You are solely responsible for Your Content and for ensuring you have the necessary rights and consents to use and collect it, including consent from viewers whose information is captured through your interactive video campaigns.

8. Third-Party Integrations

The Service can send data to third-party destinations you configure, such as Zapier, Make, CRMs, and autoresponders. Once data leaves the Service through a webhook or integration you've set up, its handling is governed by that third party's own terms and privacy practices, and we are not responsible for how those third parties process it.

9. AI-Generated Content

AI Pro features generate suggested copy (CTAs, opt-in text, popup offers, follow-up emails, and similar) based on your inputs. AI-generated suggestions are a starting point only; we do not guarantee their accuracy, suitability, or performance, and you are responsible for reviewing and editing any AI-generated content before publishing or sending it.

10. Intellectual Property

The Service, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Service, no other rights are granted.

11. Service Availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, MVP and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or business opportunity, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Service if you materially breach these Terms. You may stop using the Service and cancel your account at any time as described in Section 5.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page with a new effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
